General
The website is operated by Agripets, a licensed dealer (hereinafter: "the Company").
Nothing in these regulations shall derogate from the provisions of any law, including the Consumer Protection Law, 5741-1981, and the regulations enacted thereunder. In the event of a contradiction between the provisions of these regulations and the provisions of the law, the provisions of the law shall apply.
The website is intended to provide users with information about the company's products and services, information on promotions, ways to contact the company, and so on. The products presented on the website can be purchased through the website (remote sales), subject to their availability in stock and the provisions of these regulations.
The company is not obligated to provide a product that is out of stock, and the user waives any claim whatsoever related to and arising from this. Furthermore, products that are in stock at the stores may not appear on the website, and the user waives any claim whatsoever related to and arising from this.
It is clarified that there may be exceptional cases of errors regarding the information about the products and services on the website, including their price. These errors are made in good faith, arising from a human error or a typographical error that is conspicuously unusual. In such cases, the user will not be able to take advantage of the error and will be entitled to purchase the product or service at the correct price.
Use of the site is subject to the terms of use detailed in this policy.
Any user and/or purchaser on the company's website (hereinafter: "the actor" and/or "the buyer" and/or "the consumer"), declares - by using and/or purchasing - that they are aware of the website's terms and conditions and the rules applicable to the use and purchase of products through the company's website, that they recognize these rules, agree to their applicability to the use and/or purchase, and that they and/or anyone on their behalf will have no claim and/or demand against the company and/or the website operators and/or anyone on their behalf, except for claims related to the breach of the company's and/or the website operators' obligations according to these terms and conditions.
Wherever the masculine gender is used in these regulations, the feminine gender is also intended.
Promotions
The company's website sometimes offers products and services at special promotions, and/or special discount promotions, etc. The company does not undertake to ensure that any promotion it holds will apply to all of its customers. It is emphasized that the company is entitled to change or cancel the benefits at its sole discretion.
The company may at any time stop any promotion it is conducting, change or replace it, and cancel or change at any time any discount it provides, all as stipulated in the terms of that promotion.
Place an order
To ensure the order is processed quickly and without issues, please ensure correct details are provided; otherwise, the company cannot guarantee the order's fulfillment. Providing complete and accurate details about the purchaser and payment method are necessary conditions for completing the purchase.
When placing an order, you can choose to receive the order via courier service or self-pickup.
At checkout, you will be asked to enter your credit card details or alternative payment method, the number of installments as explained on the website, and to confirm the transaction. Occasionally, for purchases above a certain amount, the individual making the transaction may be asked to send a photocopy of their ID, in accordance with the credit card processing company's safety regulations.
Upon order confirmation by the credit card company, a relevant notification will be displayed on the computer screen. Within 24 hours thereafter, the company will check and confirm the item's availability in stock.
In the event that the transaction is not approved by the credit card company, the transaction will be void and the order will be canceled.
It is clarified and emphasized that the order will be considered complete only after receiving confirmation from the credit card company, and the company is not obligated to the customer as long as the order has not been approved by the credit card company.
All orders approved by credit card companies will be registered on the website with the appropriate status.
Registration on the company's website constitutes confirmation by the person performing the action to be included in the list of the company's customers, who are part of the company's direct mailing distribution.
Who is eligible to perform purchase transactions
Any person over 18 years of age and/or any other recognized legal entity (e.g., partnership, company, etc.) is permitted to make a purchase on the website subject to the terms of these regulations.
A prerequisite for approving the purchase action is that the user is a legal entity or is capable of performing legally binding actions. If the user is a minor (under 18) or not legally capable of performing legal actions without parental consent, the purchase action will not obligate the company.
Forbidden actions
The company may prevent a user from purchasing on the site in any of the following cases:
The customer violated a term of the regulations.
The customer provided incorrect details at the time of order and/or thereafter
The customer committed an act or omission that could harm the company or the proper functioning of the site and/or its representatives and/or any of the store owners and/or any third party.
Submitting false payment details is a criminal offense, and doing so may result in criminal and civil legal proceedings.
Responsibility
The sole responsibility for the products, their quality, their integrity, their durability, their proper functioning, and their operating specifications rests solely with the warrantor (usually the manufacturer) and not with the company.
By making a purchase, each buyer declares that the content of this section has been brought to his/her attention and that he/she will have no claim and/or demand and/or lawsuit against the Company and/or anyone on its behalf, as well as against the website operators and/or anyone on their behalf, concerning the aforementioned features, but only against the responsible party. The warranty certificate from the responsible party will be provided at the time of product delivery (if applicable).
Delivery
The products will be supplied to the purchaser by a third party (the shipping company), within the time frame specified on the shipping company's website. In the event of delays in product delivery, the company will be exempt from responsibility for these delays, and the purchaser will have no claim and/or lawsuit against the company and/or its representatives and/or the website operators and/or their representatives in connection with delivery delays. Claims should be directed against the third party.
The shipping cost is not related to the price of the products and services offered for sale and is an additional cost if the user chooses to use it. The shipping price varies depending on the shipping address and the size (weight) of the product.
The company will not be responsible for any delay or postponement in delivery and/or non-delivery caused by force majeure and/or events beyond the company's control, including lockdowns, strikes, shutdowns, and the like.
When delivering the product, the company may require the credit cardholder's presence at the time of product delivery, and/or the presentation of the credit cardholder's identification card, and/or the credit cardholder's signature on a voucher as a condition for product delivery.
The company reserves the right to change handling and shipping fees from time to time. The price applicable to an order is the price published at the time of completing the order process.
Cancellation of purchase transaction
Pursuant to section 14(c)(1) of the Consumer Protection Law, 5741-1981 (hereinafter: "the Consumer Protection Law'), the purchaser is entitled to cancel the purchase transaction by notifying the company, starting from the day the transaction was made and up to fourteen days from the day the purchaser received the product or from the day the purchaser received a document containing the details included in section 14(c)(2) of the Consumer Protection Law, whichever is later.
Notwithstanding the foregoing, in a remote sale transaction with a purchaser who is a person with a disability, and/or a senior citizen, and/or a new immigrant, the purchaser may cancel the transaction within four months from the date of the transaction, from the date of receipt of the property, or from the date of receipt of the document containing the details mentioned in Section 14C(b) of the Consumer Protection Law, as applicable, whichever is later, provided that the engagement in the transaction included a conversation between the company and the purchaser, including a conversation via electronic communication.
If the buyer has the right to cancel a transaction according to the law or as agreed with the company, they may cancel it by sending a cancellation notice to the company via email to sooffdog@gmail.com
In a cancellation notice submitted by the buyer to the company, they must specify their name, ID number, and information about the product or service they wish to cancel.
In the event of cancellation of a transaction under Section 14(V) of the law and not for the reasons listed above, the Consumer Protection Regulations (Cancellation of Transaction) 5771-2010 shall apply, including with respect to the condition that the purchaser shall return them to the dealer and that the goods are not damaged and have not been used.
A customer who purchased a product for home delivery and wishes to cancel the transaction must notify the company of the cancellation no later than 24 hours before receiving the shipment. A customer who does not notify within the time frame stipulated above will be charged a delivery fee.
In any case of a buyer's request to cancel the transaction after the product has already been shipped, the buyer must return the product at their expense, as far as possible or reasonable, in its original packaging, and as far as possible or reasonable, intact and without any damage, defect, or malfunction of any kind or type, to any of the company's branches.
The results of the transaction cancellation will be in accordance with the provisions of Section 14E of the Consumer Protection Law. Accordingly
In case of cancellation due to a product defect or a discrepancy between the product and the details provided, the cancelling party shall return the product to the company. The company shall refund the purchaser within 14 days the portion of the transaction price paid by him, and his charge shall be cancelled, without cancellation fees. If the product has reached the purchaser, he must make it available to the company at the location where it was delivered and notify the company.
In the event of cancellation for other reasons, the customer must return the product to the company. The company shall refund to the purchaser within 14 days the portion of the transaction price paid by him and cancel his charge, except for a cancellation fee not exceeding 5% of the price of the item or 100 NIS—whichever is lower. If the item has been delivered to the purchaser, he must make it available to the company at the place of business and notify the company thereof.
The company may sue for its damages due to the product's value depreciating as a result of its significant deterioration in condition.
If the buyer requests that the Company arrange for the return of the returned product, whether the product has reached the buyer or is on its way, the buyer shall bear the cost of such product transportation, according to the Company's accepted transportation costs.
Additionally, products with damaged packaging, or those broken or spoiled due to improper use, will not be returned. Further conditions: No exchange/return of products that have been cut or custom-fitted. No exchange/return of consumable products (light bulbs, batteries, ink cartridges, etc.). No exchange/return of personal care products (for hygiene reasons). No exchange/return of computer, camera, or MP3 player accessories.
Payment
The purchaser will be charged for the product purchased via credit card immediately upon placing the order for the product, subject to credit card company approval.
When purchasing a product in installments, in accordance with the payment terms detailed on the website, the purchaser will be charged via credit card, subject to the credit card company's approval. The charge will be made to their account once a month in fixed installments that already include interest. No additional amounts for linkage differences and/or interest will be added to these fixed installments, which the purchaser has committed to pay for the product. These will be charged at the regular billing dates of the purchaser's credit card, in accordance with the purchase terms published on the website for each product.
All prices shown on the company's website include VAT. Prices do not include shipping and installation costs, nor any other additions or expenses that will apply to the consumer.
Additional terms
The company reserves the right to change or add to these terms and conditions. Every purchase transaction is subject to the provisions of the terms and conditions that are in effect at that time and are published on the company's website.
Information appearing on the website regarding products not manufactured by the company is provided by the manufacturers of those products, and the company does not verify this information upon its publication on the website. The company shall not be liable for any discrepancy, omission, misrepresentation, error, or false statement in the information it received as aforesaid.
The product images displayed on the website are for illustrative purposes only, and there may be differences between the products and their images. The buyer shall have no claim regarding any matter connected with or arising from this.
If factors and/or events beyond the Company’s control delay and/or prevent the sale of the products or any part thereof, in whole or in any manner whatsoever, and/or affect the delivery dates of the products to the purchasers and/or damage the computer and/or communication systems and the data system of the Company’s website, and/or if, between the date of the purchase transaction and the scheduled delivery date pursuant to the terms of purchase of the products, there are changes in the tax rates and/or levies applicable to the products subject to the transaction, the rate of which exceeds 5%, the Company may announce the cancellation of the purchase transaction
If an exceptional and clear error is found or discovered on the face of the product description, its price, the payment terms detailed alongside it, its image, or any other material related to the product, or in receiving the data from the purchaser, the Company shall be entitled to cancel the purchase transaction at any time until its delivery to the purchaser.
If it becomes clear to the company that it cannot, within its usual means, supply the products to the purchaser at their place of residence and/or it cannot guarantee that service companies will provide service to the products at the purchaser's place of residence, the company shall be entitled to cancel the purchase transaction at any time up until the product is supplied to the purchaser.
If the aforementioned transaction is canceled, the company shall refund the buyer the full consideration paid (if any) and/or cancel the credit card charge, as applicable, and the buyer shall not be entitled to any compensation for the cancellation of the transaction.
The presentation of products on this website does not constitute an opinion regarding their nature or quality.
Any message to the purchaser will be sent via SMS or email in accordance with the details entered into the system during the purchase transaction. A message sent via SMS or email shall be considered to have reached the purchaser within 7 days of its dispatch.
The company is not responsible for the proper operation of the website or for the information security on the website, even though it will act towards that goal. The user will have no claim related to or arising from this.
Privacy and data security
The company does everything possible to protect the privacy of its customers.
In this framework, sensitive information related to its customers and their accounts is not transferred to third parties, nor is information about payment methods, account numbers, and credit card details stored, thereby preventing third parties from accessing credit card details. The details are transferred directly to the secured site of the clearing company.
The company undertakes to act in accordance with the provisions of the law, including the Consumer Protection Law, 5741-1981 and Amendment No. 40 to the Communications Law (Bezeq and Broadcasting), 5742-1982.
Without detracting from anything stated in these terms, the company may, at its sole discretion, collect and store any information arising from the use of the site.
The customer is not obligated to provide their personal details. Providing such details will be at their discretion if they decide to purchase a product available for purchase on the website.
